It should be clarified from now on that the portal you are browsing is managed by the Company PNR Italia S.r.l. a Socio Unico, of which PNR America is an affiliated company. For this reason, since the General Data Protection Regulation 2016/679 (hereinafter, “EU Regulation 2016/679“) applies to the Company PNR Italia S.r.l. a Socio Unico, the processing of data within this site will take place in compliance with the legislation mentioned above.

What data do we collect and use?

Accessing the Website does not require any registration. However, there are services within the Website for which it is necessary to provide your personal data, which will be processed only for the relevant purposes and for the strictly necessary time.

Personal data collected through this Website, including, for example, first name, last name, phone number, email address, will be processed by PNR America in full respect of confidentiality in compliance with all current regulations (and therefore also in compliance with the principles of fairness, lawfulness, transparency, proportionality, and protection of privacy and rights) and with logic strictly related to the purposes indicated in this policy.

In addition to the personal data provided directly by the user, during the connection to the Website, the computer systems and software procedures used to operate the Website acquire, during their regular operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This is Browse data, information that is not collected to be associated with identified interested parties, but which, by their very nature, could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes IP addresses or domain names of the computers used by users connecting to the Website, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user’s computer environment.

This data is used solely to obtain anonymous statistical information on the use of the Website and to verify its correct functioning. The data could be used to ascertain responsibility in the event of hypothetical cybercrimes against the Website, only upon request by supervisory bodies.

For information on the cookies used by this Website, consult the Cookie Policy.

Why do we process personal data, and what is the legal basis for processing?

According to the needs manifested from time to time by accessing the various sections of the Website (and without prejudice to specific rules and information for individual operations involving the provision of specific personal data, published from time to time on the Website), the purposes of personal data processing are indicated below, i.e., those provided directly by users by filling in online forms, or those acquired automatically through Browse:

  1. to follow up on any requests made by the users themselves, for example, by spontaneously sending email or traditional messages to the contact details indicated on the Website, which involves the subsequent acquisition of the sender’s address, including email, or the relative telephone number necessary to respond to requests, as well as in the case of using the dedicated “contact us” section;
  2. subject to specific and separate consent, and until its revocation, for the proposal of offers, commercial communications and for the subsequent sending of advertising and/or promotional informative material and/or opinion surveys, market research, sending newsletters (collectively defined as “marketing activities”) on the Owner’s products and services through “automated” contact systems (email);
  3. Direct marketing if the user has selected this option;
  4. Marketing by the Company PNR Italia S.r.l. a Socio Unico;
  5. to fulfil an obligation required by law, by a regulation or by community legislation;
  6. to ascertain, exercise or defend our right in court;
  7. to obtain anonymous statistical information on the use of the Website and to check its correct functioning.

Processing is permitted as:

  • necessary to follow up on requests made by users;
  • necessary for our legitimate interests in pursuing the purposes above (e.g., verifying the correct functioning of the site and for security reasons, organizational and production needs to constantly improve the services provided to users, the quality and effectiveness of customer care);
  • in some cases, necessary to fulfil a legal obligation, for example, in the case of communication to authorities, governmental or regulatory bodies;
  • necessary to initiate, carry out or defend oneself in legal actions;
  • based on user consent.

Is it necessary to provide personal data, and what are the consequences of refusal?

The provision to PNR America of your personal data, which is requested on various collection occasions, may be necessary for the pursuit of the purposes identified in the specific information, or optional.

The mandatory or optional nature of the provision is specified by the symbol (*) placed next to the mandatory information.

Any refusal to communicate specific personal data marked as mandatory to PNR America makes it impossible to pursue the primary purpose of the specific collection: such refusal could, for example, make it impossible for PNR Italia to provide the services available on the site (the assistance services of our customer service, the sending of newsletters).

The provision to PNR Italia of additional personal data, other than those marked as essential, is instead optional and does not entail any consequence concerning the pursuit of the primary purpose of the collection.

Who has access to personal data, and with whom are they shared?

Your personal data will not be disseminated. Your data will be communicated to third parties only with your express consent, except in cases where the communication is mandatory by law or is necessary for purposes provided by law for the pursuit of which the permission of the interested party is not required; in such cases, the data may be made available to third parties who will process them autonomously and solely for the purposes mentioned above (for example, in the case of a request made by the police or the judiciary or other competent bodies or to fulfill obligations arising from the contract concluded with you).

As indicated in the introduction, the management of this site is carried out by PNR Italia S.r.l. a Socio Unico that may use your data for purposes other than site management (e.g., sending newsletters, marketing) only with your prior and specific consent.

How do we process personal data, and how long do we keep it?

Personal data will be processed manually, electronically and telematically and for a period of time no longer than necessary to achieve the purposes for which the personal data are collected, or for a more extended period, for purposes permitted by law, and in any case, deleted without unjustified delay. We will, however, retain user personal data if complaints or disputes are ongoing.

In processing data that can, directly or indirectly, identify you, we try to respect a principle of strict necessity. For this reason, we have configured the Website in such a way that the use of your personal data is reduced to a minimum: therefore, the processing of your data is excluded when the purposes pursued in individual cases can be achieved through the use of anonymous data (such as, for example, in market research aimed at improving services) or through other methods that allow the identification of the interested party only if necessary or at the request of the authorities and police forces (such as, for example, for data relating to traffic and your stay on the website or to your IP address).

Can we transfer personal data to third countries or international organizations?

We inform you, finally, that your personal data will not be transferred abroad to countries other than those belonging to the European Union, which do not ensure adequate levels of protection for individuals. In case it is necessary to provide you with services, we assure you that the transfer of your personal data to countries that do not belong to the European Union and do not ensure an adequate level of protection will be carried out only after the conclusion of specific contracts between PNR Italia and said parties in accordance with applicable law and regulations.

How is the security of personal data guaranteed?

We adopt adequate security measures to minimise the risks of destruction or loss, even accidental, of data, unauthorized access or processing that is not permitted or does not comply with the collection purposes indicated in our Privacy Policy.

The transfer, storage and processing of your data collected through the Website is ensured by appropriate technical measures. However, PNR America cannot guarantee its users that the measures adopted for the security of the Website and the transmission of data and information on the Website limit or exclude any risk of unauthorized access or data dispersion by devices belonging to the user: We advise you to ensure that your computer is equipped with adequate software for the protection of data transmission over the network, both incoming and outgoing (such as updated antivirus systems) and that your Internet service provider has adopted suitable measures for the security of data transmission over the network (such as firewalls and anti-spam filters).
